These Terms govern all interactions with our platform, including browsing, bidding, purchasing, listing, communicating, and creating an account.

1. ELIGIBILITY

2. ACCOUNT REGISTRATION

We reserve the right to suspend or terminate accounts at our discretion.

3. BUYER TERMS

A. Binding Purchases

When you place a bid, offer, or purchase an item, you create a legally binding contract to complete the transaction.

B. Payment Requirements

You agree to:

  • Pay all charges promptly

  • Use valid payment methods

  • Cover shipping, taxes, and any applicable fees

Failure to pay may result in account suspension or cancellation of the transaction.

C. Buyer Responsibilities

Buyers are responsible for:

  • Providing accurate shipping information

  • Inspecting items upon delivery

  • Reporting issues within the required timeframe

  • Understanding item conditions (new, used, vintage, as-is, etc.)

4. SELLER TERMS (If Applicable)

If you list or sell items on Only The Finest, you agree to:

  • Accurately describe items

  • Provide real photos and honest representations

  • Ship items within stated handling times

  • Comply with all laws, including shipping restrictions

  • Resolve disputes in good faith

Only The Finest reserves the right to remove listings that violate our policies.

5. AUCTION-SPECIFIC TERMS (If Applicable)

For auction events:

  • All bids are final and non-retractable

  • Winning bidders are obligated to complete the purchase

  • Items may be sold as-is without warranties unless stated otherwise

  • Auction closing times or formats may change due to technical issues

We are not responsible for last-second bidding delays or network interruptions.

6. PROHIBITED ACTIVITIES

Users may not:

  • Engage in fraud, misrepresentation, or chargeback abuse

  • Manipulate prices, bids, or feedback

  • Post unlawful, harmful, or infringing content

  • Harass or abuse other users

  • Use bots, scripts, or automated systems

  • Interfere with site security or operations

  • Circumvent our fees or platform processes

Violation may result in account termination, legal action, or reporting to authorities.

7. ITEM CONDITION, AUTHENTICITY & DISCLAIMERS

Unless explicitly guaranteed:

  • Items may be sold as-is

  • Vintage, used, or collectible items may show wear

  • Descriptions are based on seller opinion

  • Only The Finest does not certify authenticity unless stated

  • Grading (PSA, BGS, SGC, etc.) is subjective and not guaranteed

You acknowledge that you are responsible for reviewing item descriptions carefully before purchase.

8. FEES & PAYMENTS

Users agree to pay:

  • Purchase prices

  • Buyer premiums (if applicable)

  • Shipping costs

  • Taxes and duties

  • Any platform or processing fees

Fees may change at any time with notice.

9. SHIPPING & DELIVERY

Our Shipping Policy governs:

  • Handling times

  • Packaging standards

  • Insurance

  • Lost or damaged shipments

  • International orders

By purchasing, you agree to that policy.

10. RETURNS & REFUNDS

Returns are handled according to our Return/Refund Policy (if offered).
Some items—especially auction lots, graded cards, estate goods, and “as-is” items—may be final sale.

We reserve the right to deny refunds for:

  • Buyer remorse

  • Late reporting of issues

  • Item alterations or damage caused after delivery

11. PRIVACY

By using the Services, you consent to our handling of your data as described in that policy.

12. PLATFORM AVAILABILITY

We do not guarantee continuous, uninterrupted access to the Services.
From time to time, the platform may experience:

We are not liable for losses resulting from downtime.

13. INTELLECTUAL PROPERTY

    • Shipping carrier delays or damages

    • Misuse of the platform

    • Technical issues outside our control

You use the platform at your own risk.

15. INDEMNIFICATION

You agree to indemnify and hold Only The Finest harmless from any claims, losses, liabilities, damages, disputes, or expenses arising from:

  • Your use of the Services

  • Your violation of these Terms

  • Your violation of law or third-party rights

  • Your misconduct or fraudulent activity

16. TERMINATION

We may suspend or terminate your access at any time for:

  • Violations of the Terms

  • Fraud or suspected fraud

  • Failure to pay

  • Abuse of the platform

  • Risk to other users

Termination does not relieve you of outstanding payment obligations.
